1. Our Service

Cloudays provides a digital platform for personal journaling, note taking and media storage.

Features include:

• Text input and editing: clean formatting tool for journaling
• Daily photo log: Take photos using in-app camera or select images from the library for any date
• Calendar memory grid: view and access daily entries in calendar view
• Home screen widgets: Showcase past journals and fast access shortcuts
• Visual photo gallery: browse photos from past memories
• Dashboard: show user’s journaling progress

User content and session data are stored on the user's device. The Service is offered as-is and subject to these Terms.

2. Eligibility and Account

To use the App:

• You must be at least 13 years old.
• Cloudays does not require you to create an in-app account. Where subscriptions are involved, you are responsible for maintaining the security of your Apple ID, which Apple uses to process your purchases.
• Session data is stored on the user's device. Deleting the application from your device will remove all stored data, settings, and session history.

3. Subscriptions and Billing

3a. Subscriptions

The app is available through subscriptions which may include:

• Weekly subscription
• Monthly subscription
• Yearly subscription

For iOS, all subscriptions are processed through the Apple App Store (In-App Purchases).

By purchasing a subscription, you agree to Apple's End-User License Agreement. Prices are subject to change and are displayed in your local currency.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorise recurring charges until you cancel. While we use Apple App Store (In-App Purchases) to process payments, we use a third party service to verify and manage user's subscription entitlements.

3b. Cancellation & Refund

For app purchased through Apple's App Store (In-App Purchases), you can manage or cancel your subscription in your Apple ID settings. Refunds are handled by Apple through reportaproblem.apple.com.

4. Changes to Service

We reserve the right to update, modify, suspend, or discontinue the Service, or any feature of the Service. Subscription prices may change from time to time. Any updated pricing will be communicated through the App Store or within the Service, as applicable. We may revise these Terms at any time. When changes are made, the updated Terms will be posted within the Service and will become effective upon posting unless otherwise stated. By continuing to use the Service after the revised Terms take effect, you agree to be bound by the updated Terms.

5. Privacy & Data Usage

We process personal data in accordance with applicable data protection laws. Please refer to our Privacy Policy for full details.

Application session data is stored locally on your device. We do not operate user data servers for general app functionality. Limited data may be processed by third-party providers where necessary, including subscription management, entitlement verification, and receipt validation.

6. Intellectual Property Rights

Cloudays owns or licenses all intellectual property rights in and to the App and its content, including but not limited to software, graphics, text, and branding. These Terms do not grant you any rights to use Brewfy's name, logos, or other brand features without prior written permission.

7. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Brewfy disclaims all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits or excludes any rights you may have under applicable consumer protection laws that cannot be lawfully excluded or limited.

To the fullest extent permitted by applicable law, Brewfy shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.

8. Indemnification

You agree to indemnify and hold harmless Brewfy from any claims, damages, or legal fees arising directly from your violation of these Terms or your misuse of the Service.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.

10. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms or misuse the Service.

11. Acceptable Use

You agree not to misuse the Service or use it in any way that could damage, disable, overburden, or impair the Service or interfere with any other user’s use of the Service. You must not attempt to access or disrupt any systems, infrastructure, or security features related to the Service.
